Beyond the obvious defect with your argument -- which is "who gets to decide what counts?" -- you simply must understand that the 1st Amendment very much does protect speech...even if you, or anybody else, considers it hate speech or misinformation.

Who determines what is hate speech? Ditto for misinformation. Here’s a real mind blower, how about countering speech you don’t like (incl ‘hate speech” or misinformation) with “nice speech” or good information? Liberals use to be for more free speech, not less.
