Unborn fetuses and NOT human beings yet

They can not breath, get nutrients, or have any kind of movment without the help of other things I the woom. So how is something murder if murder is take a life but the "baby" wasn't even born yet? You are ALIVE from the moment you are born to the moment you die meaning that if you are not born yet you are not alive yet.
